What You need to know about Accidental Death and Injury claims, insurance and lawsuits
The founders of our Republic understood the importance of giving ordinary people the ability to hold individuals, insurance companies and the government accountable when they injure someone. That is why the right to trial by jury in civil cases is in our Constitution. But sadly, in recent years large insurance companies and business lobbying groups have made our civil justice system the target of derision. These tactics have eroded public confidence in the civil justice system by mischaracterizing the civil court systems as a “lawsuit lottery” and unfairly criticizing and ridiculing real victims.
This is wrong. It deters good people who have been hurt because of someone else’s fault from pursuing their legal rights to money damages and compensation. Even worse, it allows wrongdoers to escape their moral obligations to repair the damage that they have done, and it allows their insurance companies to escape their legal obligations to fairly pay for the real losses suffered by real victims.
If you have suffered serious personal injuries or lost loved ones because of someone else’s fault, you have nothing to be ashamed of in bringing a claim for money damages or in prosecuting a valid lawsuit. But, you do need to understand how the civil justice system works, so that you are equipped to work with us in preparing your claim and in dealing with the stress and overcoming the trauma of a disabling injury or loss of a loved one.
